Welcome to HomeTivi. These Terms of Use (the "Terms") govern your use of the HomeTivi platform (including the website and mobile apps, the "Service"). By using the Service you agree to these Terms.
1. The Service
HomeTivi is a platform that lets users publish and discover property videos for sale or rent in a video-first format. HomeTivi is not a real estate broker; the content owners who produce the videos are solely responsible for their accuracy.
2. Account and Age Requirements
- You must be at least 18 years old to use HomeTivi.
- You agree to provide accurate, current and complete information when creating an account.
- You are responsible for the security of your account and the confidentiality of your credentials.
- Business accounts may require additional verification; videos may not be published before verification is complete.
3. Content and Licence
You retain all intellectual property rights in the videos, images, descriptions and comments you upload ("User Content"). By uploading such content, you grant HomeTivi a worldwide, royalty-free, non-transferable licence to host, copy, distribute, display and make available that content within the Service. This licence ends when you remove the content from the platform (it may be retained for a reasonable period for backup/technical requirements).
3.1 Content Rules
You agree not to upload the following to HomeTivi:
- Misleading, fake or non-existent videos.
- Content that infringes someone else's copyright or trademark rights.
- Content containing hate, discrimination, harassment, threats or violence.
- Pornographic or 18+ sexual content.
- Spam, fraud, phishing or links containing malware.
- Material that violates the privacy of third parties (personal data shared without consent).
- Any content that is unlawful.
3.2 Moderation
HomeTivi may review uploaded videos before publication and reserves the right to remove content that breaches the rules, warn the user, or suspend the account temporarily or permanently. You may appeal moderation decisions through HomeTivi support channels.
Private messaging: Private messages between users are stored with symmetric encryption in the database. The HomeTivi team may view message content only in case of a complaint, suspected fraud, harassment investigation or a request from a legal authority, and only by recording the reason for access in the system. These accesses are stored as auditable logs. HomeTivi does not use your messages for marketing or advertising and does not share them with third parties.
4. Prohibited Conduct
- Overloading or abusing the Service with automated tools (bots, scrapers).
- Attempting to take over other users' accounts.
- Circumventing the platform's security measures or reverse engineering its source code.
- Creating multiple fake accounts to generate artificial engagement.
- Sending unsolicited marketing messages to other users.
5. Terminating Your Account
You can delete your account at any time under Settings → Data and Account. HomeTivi reserves the right to suspend or terminate your account if it determines that you have breached these Terms.
6. Limitation of Liability
The Service is provided "as is". HomeTivi is not liable for the accuracy of videos, disputes arising from communication between users, or damages caused by third-party links. To the maximum extent permitted by applicable law, HomeTivi's total liability is limited to the fees you paid in the last 12 months (or zero if no payment was made).
7. Changes to These Terms
HomeTivi may update these Terms from time to time. If significant changes are made, you will be informed through HomeTivi or by email. Continuing to use the Service after a change means you accept the updated Terms.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. The Istanbul (Çağlayan) Courts and Execution Offices have jurisdiction over disputes arising from these Terms.
